officer-involved shooting happened. this is the second one so far this year. the other happened about two weeks ago. with this incident, the scary part, there were actually people playing in the park right here. and a few yards away from that, tree view elementary school's playground. just before 11:15 this morning, a haywood police officer came up on this honda accord, reported stolen. as the officer approached the car, he saw a man sitting inside. >> he ordered that occupant several times to show his hands and put his hands in the air. the suspect did not comply. >> reporter: investigators say that's when the officer looked over and saw the suspect reaching for a weapon. >> at that point, the officer fearing that the suspect was arming himself was forced to use lethal force. >> reporter: at that same time, hamid abdul was driving his car less than a block away from home. he says he saw the officer telling the suspect something and the next thing he knew, he heard three shots. >> i was scared. that's why i made a quick left onto another street, right there, and i parked my car. >> reporter: police would not say what kind of weapon the suspect had, but did say it was

within reach inside the vehicle. the suspect was transported to eden hospital, where he later died. neighbors are concerned a stray bullet could have entered this elementary school playground. >> it's sad. it's really sad they would do it so close to a school. >> we did lock down the school and we ensured there was no injuries to any of the staff or the students. >> reporter: now, after the scene was secured, police contacted the school to let them know it was all clear to have recess. police have not released identity of the suspect, but said there was a chance there was more than one weapon in the vehicle. paul chambers, ktvu channel 2news. attorneys have filed a motion yesterday to place the oakland police department under federal control, now explaining why they made that request. claimant's attorneys say the opd has failed to fully implement court-sanctioned reforms ordered almost 10 years ago. the reform stem from the 2003 settlement of the rider's misconduct case. >> we hope that when a receiver

is appointed that they will focus on the complete failure of supervision on the opd and by city officials that has taken place since we signed this agreement in january 2003. >> a hearing is set for december to discuss the motion. the city is expected to fight the request. oakland police have arrested two people in connection with an armed jewelry store heist. oakland residents re own in a lampkin and richard nguyen are are charged with three counts of second degree robbery. police say they are two of four people who robbed the pave jewelry store back in august. police are still looking for the other two suspects. in vallejo, police are are giving more information about a deadly shooting involving three friends. two men were killed. the third friend is the suspect. officers say 50-year-old michael scowly and douglas caylee were shot and killed by their friend and neighbor, 65-year-old martin

honiger. the incident, around 6:00 p.m. wednesday night, has stunned residents of the glenn cove community of vallejo. police say there was some type of argument before the killing. in san jose, a teacher in jail accused of molesting a student and now notes taken by the principal at the school have just been made public. ktvu's robert honda is here and tells us those notes could be key evidence against both the teacher and the principal. robert? >> reporter: well, that's right. the teacher in this case has been spending most of his time here at the santa clara county jail on charges related to child molestization. we obtained notes written by the principal, who faces a misdemeanor charge herself of not reporting the teacher's actions to the proper authorities. the court documents released by a judge yesterday include hand-written and typed notes from the ob way lee school principal of conversations she had with the accused teacher, craig chandler and the second grade student he is accused of molesting. according to the notes, the student told the principal that

chandler blindfolded her, wiggled her head and body, asked her to open her legs and other acts that law enforcement believe should have been enough for the principal to report the incident as required by law. authorities and child advocates we talk to say the notes reinforce that belief, especially since chandler was accused of molesting another child three months later. >> obviously, we believe that the notes are the most compelling evidence we have of the student reporting an obvious situation of molestation to the principal, that we believe had to be reported to law enforcement. >> for me, this is a very clear child molestation case, us a it was reported to the principal initially. >> no way you think this should have been interpreted any differently? >> i don't see no way, absolutely no way. >> reporter: the attorney for the principal did not return our calls. the evergreen school district sent us a statement, saying it takes the allegations seriously and is cooperating fully with law enforcement. live in san jose, robert handa,

channel 2news. san jose firefighters put out a brush fire near a homeless camp early this morning off oakland road next to the san jose municipal golf course. fire crews were able to keep the fire from spreading to the brush and trees around the homeless camp. a car crashed into the -- killing the driver. chp says the car immediately burst into flames. the accident backed up traffic on both interstate 880 and highway 237 until about noon. the next phase of the highway 4 widening project is now ready to go. state and local officials held a ground breaking ceremony at highway 4 and hillcrest avenue in antioch this morning. the widening will also make room for the e bart extension from pittsburg to antioch, a system that will run diesel trains. officials say it will benefit commuters. >> it's going to go from four lanes to eight lanes, so you

double the capacity of the existing highway, but you'll also add more seats on the bart system. >> cal trans hopes to have this widening project completed by 2015. city college of san francisco will soon be getting a special trustee to oversee its finances as it tries to keep it accreditation. ccss request's for trustee was approved yesterday by the california community college's board of governors. a trustee is now expected to be appointed in the next few weeks. the community college has until the 15th of this month to submit an action plan to turn itself around and prevent the school from possibly being closed next june. president obama's reelection campaign saw a record-breaking month for fund-raising in september. sources say the amount raised last month exceeded $150 million. that's more money raised than any other campaign this election cycle. the obama camp declined to comment on the numbers.

there's no word yet on how much money mitt romney raised. the deadline to report the official numbers to the federal elections commission is october 20th. the moderator for this week's presidential debate is defending himself, after receiving much criticism about his performance. some faulted faulted jim -- for letting candidates go over time. he says he feels like he accomplished his goal. tensions are escalating after violence in syria continues to spill over its border into turkey. turkish troops today returned fire after another mortar shell from syria landed on turkish soil in a rural area along the border. no one was hurt. but this comes after turkish forces were deployed along the border earlier this week, after a shell fired from syria killed five turkish civilians. unemployment reaches a level we haven't seen in almost four

. movado firefighters issued a shelter in placed on this afternoon after a construction crew cut through a gas line in the hamilton area. people reported smelling gas in bowling circle. pg&e crews expected to have the pipe repaired in the next 90 minutes or so. the nation's unemployment rate dropped below 8% last month for the first time in nearly four years. the labor department reports the september figure at 7.8%, down from 8.1 in august. the nation added 114,000 jobs. as emily smith reports, both candidates for president immediately spun these numbers to support their side. >> reporter: the unemployment rate reported friday was better

talking a little trash to cincinnati's mayor, all part of a friendly wager here. with both city's fire departments known for their chili, today, the two mayors bet on their home teams with a chili cookoff hanging in the balance. the loser will host a chili fund-raiser at a local fire house with the proceeds benefiting youth programs in the winning city. mayor lee says he can't wait to taste the cincinnati fire department's famed recipe. the giants and reds again face-off in game one tomorrow night at 6:30 at at&t park. game 2 will also be at at&t on on sunday at the same time. the division series then moves to cincinnati for game 3 and 4 and 5 if necessary. the a's will be playing the american league central division champs, detroit tigers. the first two games will be played in detroit at comerica park. game 1 is tomorrow at 3:00 our time. game 2 is sunday at 9:00 a.m. in the morning, our time. game 3 in oakland, that one is scheduled for 6:00.

showing him with various ground breaking technology. they hope today everyone will reflect on how jobs made the world a better place. in cupertino, where apple is headquartered, the city is remembering jobs by lowering flags in civic center to half staff. a top exec at twitter is leaving. elizabeth wield today announced she is joining a venture capital firm. she made today's announcement, appropriately enough, with a tweet. a nearly seven-year wait has ended for a 36-year-old native of mexico who finally received a new kidney at uc san francisco medical center. jesus navarro is recovering tonight, following successful transplant operation last week. the immigrant at one point was taken off the donor list, some, say, because of his immigrant status. >> to my knowledge, there have

been very few transplants provided to undocumented immigrants. there is no reason to deny someone a transplant, just because they are not a legal immigrant. >> earlier this year, navarro's story received a lot of attention, prompting san ramon resident sam keegan to came up his cause and help. >> all ucf wanted was to ensure he would receive post transplant care. so once we could prove to them that he would receive proper post transplant care, then they made him active on the list again. >> keegan himself is also an organ recipient who received a kidney from a nicaraguan immigrant. he says more than 100,000 people across the country signed petition on change.org. ucf officials insisted it was a misunderstanding that led to navarro being put on inactive status on the donor list. they say the primary concern was that he would not have reliable post transplant care.

food and drug administration says it found salmonella in a new mexico plant that produces peanut butter for trader joe's, whole foods, target, and safeway. the trader joe's peanut butter is now linked to 35 salmonella illnesses in 19 states, and at least two people have gotten sick here in california. sunland, inc. has expanded its recall now to include all products manufactured in the plant in the last two and a half years. zynga's stock closed today near its lowest level ever. the san francisco-based social gaming company finished the day at 2.48 a share, off nearly 12% from yesterday's close. after-hours yesterday, zynga forecast a third quarter loss on weak revenues from its web-based games. zynga's ipo opened last december at $10 and its stock was trading as high as $16 a share last march. gas prices have shot up overnight. just ask a food truck operator how the increase is hammering a

. just getting around is getting more expensive. and the pain at the pump is not letting up. since we told you about the soaring gas prices here at 5:00 just yesterday, they have hit a new high in some places. ktvu is live in oakland with how businesses and people are coping with this sudden increase. with the price of gas here in downtown oakland at $4.88 a gallon for regular, it's no wonder that small businesses that use a lot of gas such as

these food trucks at the oakland art murmur are getting especially hammered. the cry heard around the bay area today, as the price of gas breached the $5 a gallon mark at some stations. food truck operators say they run on tight margins, so soaring gas prices eat into the bottom line. these trucks get poor gas mileage, then add in a gas-powered generator and the cost of doing business goes up another $200 a month, just because of the gas price increase. >> we don't want to pass it along to the customer, but at some point, i guess we'll have to. >> reporter: at the j miller flower shop on piedmont avenue, the delivery truck was filling up. the owner says the gasoline bill has about doubled the past year. >> what we try to do, when we have a lot of deliveries in certain areas, we try to batch them together so that we're taking a whole van load out at one time and not one delivery here, one delivery there. >> reporter: cab drivers do the

math on what they are spending for gas and don't like what they come up with. >> we are losing, like $10, $15 a day, paying more on the gas price. >> reporter: some commuters are cutting back. >> probably won't be filling up my tank all the way today. just enough to get me where i need to go. >> reporter: others are just trying to ride out the storm, hoping it doesn't last much longer. >> every time it goes down, refinery blows up, and they jack it back up again, you know what i mean? it's like it's on purpose or something. >> reporter: most people we spoke with say they are confident the spike is only temporary, but if it does last, delivery charges and food prices could start going up. reporting live in oakland, rob roth, ktvu channel 2news. some gas station operators chose to shut down temporarily rather than pay the rapidly rising wholesale prices. the giant discounter costco closed this and other stations in southern california. some other stations were charging more than $5 a gallon. coming up in 13 minutes,

what's behind this big gas price spike? we look at some of the factors that have pushed prices close to $5 a gallon. tesla cea is dismissing concerns that they face financial problems. last week, they cut its full year revenue forecast and said it was raising another $150 million by offering more shares. the ceo says there's nothing to worry about and says tesla is making an advanced payment on the federal loan used to make its model s sedan. tesla became a target during this week's presidential debate, when mitt romney branded tesla has one of the government-supported losers in green technology. a woman from morgan hill was arraigned this afternoon in santa clara county on charges of commercial burglary and contributing to the delinquency of a minor. 38-year-old marci erica did not enter a plea. she was arrested in nevada. investigators say that's where she fled after she told her

10-year-old daughter to shop lift at a safeway store in morgan hill and store employees stopped the girl as she was trying to leave the store. that happened last month. albany police chief today said his department will not publicize details of molestation allegations against a teacher who apparently committed suicide this week. the body of albany middle school teacher james izumizaki was discovered monday in a car outside his family's home. last month, he was arrested on suspicion of lewd acts on a child and later released on bail. alameda county prosecutors have not formally charged the man. police say they will continue their investigation until all known leads are exhausted. tonight, new details of the first contra costa rabies death in 20 years. our health and science editor john fowler tells us why it's an international first for an american and what it means for bay area residents. >> reporter: it happened somewhere in south contra costa county, where freeway overpasses offer ideal homes for colonies

of mexican free tail bats. the species linked to this case of rabies. >> once the symptoms develop, it's universally fatal. >> after a bite or exposure to wild animal, the incubation phase is two to six months. >> reporter: health officials say the unidentified 34-year-old man was outside with friends who had found a bat, quote, flopping on the ground. one of them had the bat in a plastic bag. >> the gentleman who died of rabies went over and stuck his hand in the plastic bag and most likely was bitten. >> reporter: said to be a bay bridge contractor, he never reported the bite in march, took civilian work in iraq, and became infectious. the cdc says he flew home to contra costa county june 14th. four days later, san francisco to bangkok for two weeks vacation, had close contact with two people, flew back to san francisco, flew to dubai for treatment, then zurich where he died on the 31st.

>> there were 59 people who were identified and 23 of those people internationally received post exposure prophylaxis. >> reporter: health officials today said the man's family also got shots. they urge people to avoid all contact with wild animals acting unusual and all bats, underscoring that immediate treatment can save lives. john fowler,ktvu channel 2news. flu season is right around the corner and california's department of public health is urging californians to get vaccinated. this year's flu vaccine contains two different strains that were not part of a vaccine distributed last year. >> influenza viruses that circulate each year often change every year. >> according to the centers for disease control and prevention, the flu and related complications are the eighth leading cause of death in the united states. the number of meningitis cases linked to an injectable steroid has now risen to 47 across the country. they have spread across seven

states. california is not one of them. there have been five deaths from meningitis believed to have been spread by the use of the steroid. california health officials say facilities in three counties received the drug which has now been recalled. layoffs are looming for american airlines workers here in the bay area. plus, what the carrier says it's done to solve the problem of seats coming loose on its plane. >> bay area gas prices are well on their way to a new record. the question is, could this be soon in our future?

. more than 11,000 american airlines employees could lose their job as part of bankruptcy reorganization. the airline says almost 1100 layoffs could be in california alone, including 224 in san francisco, and 42 in san jose. the rest would be in los angeles, san diego, and smaller airports around the state. and american airlines spokesperson says the numbers aren't definite just yet and may actually be a lot less before the final decision is made by the end of the year. this comes as american airlines is still dealing with a problem that is causing seats to come loose. the airline has pulled at least 48 planes out of service to repair the problems. it says the work should be done by tomorrow. american originally thought the issue was finished today, but then it had to cancel more than 40 additional flights today.

workers are repairing locking pins that can pop out due to wear and dirt on the airline floors. the secret service has new rules for its employees. they cover what agents and others can post or tweet on facebook. the secret service is telling them not to post anything related to work. an agency spokesman says social networking rules are not the result of a scandal in which agents were accused of bringing prostitutes to their hotel rooms on a trip to central america. this fall's tv season will have the highest number of gay, lesbian and bisexual characters ever on prewritten broadcast shows, according to the gay and lesbian alliance against defamation. the 17th annual report from glad says that about 4.4% of actors on tv will play gay characters. that's up from 2.9% the last season. among broadcast networks, abc has the most gay characters. fox is second. the number of gay or lesbian characters on cable is also going up. . well, there are many reasons

high on gas prices today and other records may fall soon. >> reporter: today, aaa average gas price stands at $4.55 for a gallon of regular. yesterday, it was 16-cents cheaper. a week ago, 37-cents cheaper. a year ago, 70-cents a gallon less than today. >> we are seeing a big cutback in supply for california. >> reporter: the fire-crippled richmond chevron refinery means less gas will be getting to market for months to come. and a major problematic chevron crude oil pipe loin into the bay area has been shut down. >> so when we see a disruption in the pipeline bringing crude in, that fairly quickly starts showing up in a disruption in the production at those refineries. >> reporter: plus, a power failure at a southern california exxon refinery severely hampered its production. several planned maintenance shutdowns are in the works. some refineries are cutting back on production, preparing to change over to winter gasoline

no cost. the researchers enrolled 9000 women in what was called the contraceptive choice project. many participants were poor and had no insurance and low education. the abortion rate for every 1000 women in the study was less than 8. that is much lower than the national rate of 20 abortions for every 1000 women. the study was conducted between 2008 and 2010 at washington university school of medicine in st. louis. a new warning tonight for heavy smokers and drinkers. researchers say you may face pancreatic cancer earlier in life. a new study from the university of michigan finds pancreatic cancer is diagnosed almost 10 years earlier, at age 61, in heavy smokers and drinkers compared to people who don't drink or smoke. the study also found that beer drinkers were diagnosed with pancreatic cancer at an earlier age than those who drank other types of alcohol, such as wine or liquor. bee keepers in france say they are seeing strange colored

remember what today was like from start to finish, i suspect tomorrow and sunday are going to be very similar, in terms of cloud cover, in terms of wakeup temperature, in terms of wind speed, everything. we've got a low pressure system sitting offshore right here and it's just kind of -- it's not making weather stagnant, but it's killing the pressure gradient. we're not seeing a lot of wind or fog formation because the inversion is thick, the atmosphere's thick, so the fog is having a tough time forming, and it's going to stay there. kind of what you see today is what you'll see tomorrow and sunday. sunday, a few more clouds, a little cooler. even on sunday night, monday, might see a sprinkle. basically, bottom line, it's a cool, mild weekend. there will be morning low clouds and fog, as you would suspect. this low pressure center doesn't go anywhere until sunday or monday. that's where we get the chance for a sprinkle. as we go into the bay area weekend highs in the 60s mostly. some low 70s as well. then as we look at sky cover, we're basically looking at partly cloudy, sometimes mostly cloudy like it was today, and

. former manager at the september 11th memorial in new york city filed a lawsuit today, after he was fired last month for raising security and health concerns. according to the lawsuit, the facility's director alerted his bosses that the water in the memorial signature fountains carried illness-causing bacteria. he also complained about the lack of security checks and exit gates he said were too narrow and could hinder an evacuation. the lawsuit seeks unspecified damages under new york's whistle

blower protection law. salinas police say they do not have any plans to charge a man who shot two teenagers who officers say were holding up a restaurant at the time. one of those teenagers ended up dying. it happened last night at a restaurant on north sanborn road. police say the teens were holding several customers and employees at gunpoint, demanding money. police say when the man came to pick up a friend, he saw the robbery, went to his car to get his gun, the confronted the robbers, shooting them in the process. the robbers took off, but showed up at a hospital half hour later, where one died. the other underwent surgery. we told you about the possible parole of a member of the infamous manson family yesterday. today, there is an outcry from some victims' families. a california parole board recommended the release of bruce davis. the 70-year-old spent 40 years in prison for the murders of gary hinman and donald shorty shea. but davis was not involved in the infamous tate-la bianca

murders. prosecutors and victims' families say that doesn't matter. >> he's flown under the water, because lot of people think watson was the main man. but it's not true. bruce davis was the second in charge. >> when you're in the room with these people sitting as closely as i do, you can see the lack of emotion. >> governor jerry brown can reverse the decision and keep davis in prison. that's what governor arnold schwarzenegger did in 2010. other manson family involved in the murders remain in prison, of course, along with charles manson. california will not be implementing a national law to track sex offenders. the program is supposed to link all 50 states into a national system for registering and tracking sex offenders. california and four other states decided not to implement the program because of doubts about how it works and how much it costs. that means the state will lose some federal law enforcement funding. 16 states have fully implemented
